What is a Pedigree Trust?

A pedigree trust (also known as a linear descendants discretionary trust) is a type of discretionary trust established to ensure that the property of the trust will remain within a particular family (normally defined by direct, i.e., blood relationship to a particular individual). 


Such trusts are often set up in an attempt to protect the trust assets in the case of marriage breakdown


Pedigree trusts are often used:

  • to protect the trust assets in the case of marriage breakdown from the Family Court's reach; 
  • to ensure that the property of the trust will remain only with the “blood relatives” of the initial nominated trust beneficiary;
  • to maximise the chances that assets will provide for the education and upbringing of children or grandchildren.
